Abstract: From the perspective of the territoriality of patent rights and the normalization of the risk of overseas patent infringement, taking the railway communication signal products as the object, this paper investigates the importance of preventing and resolving the risk of overseas patent infringement to enterprises. From the three aspects of "prevention and early warning in advance, coordinated handling in the event, and summary and promotion afterwards", different dimensions such as patent layout and application, patent early warning and response, patent invalidation and infringement litigation, this paper formulates risk prevention and resolution strategies, and builds an institutionalized, information-based, professional and full-staff overseas patent infringement risk management system to comprehensively improve the ability of overseas patent infringement risk prevention and control of enterprises.

摘要： 以专利权的地域性、海外专利侵权风险常态化为视角，以铁路通信信号产品为对象，考察防范化解海外专利侵权风险对企业的重要性；从“事前防范预警、事中协同处理、事后总结提升”3个方面，专利布局与申请、专利预警与应对、专利无效与侵权诉讼等不同维度，制定风险防范化解策略；构建制度化、信息化、专业化及全员性的企业海外专利侵权风险管理体系，全面提升企业海外专利侵权风险防控能力。
